Any changes would need to be acted on by the Legislature. The CCAC unanimously approved these recommendations. There would be no conflict with calculating the state surcharge based on valuation, as statutorily required.The only variables for building permit fees would be the size of the building and municipality fee schedule.Municipalities would maintain control over their fee schedule and cost of permits.There would be uniform statewide valuation.If the Legislature thinks changes are needed, it could require DLI to establish a statewide standard valuation on a cost-per-square-foot basis. Permit fees for commercial construction and residential remodels should continue to be assessed based on valuation because the variations in project complexity are more closely tied to valuation and generally reflect the complexity of services provided. However, if the Legislature still wants to enact changes to the permit fee structure, they should be limited to new one- and two-family dwellings and townhouses. The TAG did not reach consensus on changing the calculation of permit fees. The other recommendation is that any additional changes to this report would be handled administratively through DLI by working with impacted stakeholders. All municipalities must submit a report, but if their expenses meet the threshold, they have to provide additional information. This monetary threshold generally triggers when more reporting is necessary by municipalities who enforce the State Building Code. Any threshold change would need to be acted on by the Legislature. The CCAC unanimously approved the recommendation to increase the reporting threshold for the Municipal Fee and Expense Report from $5,000 to $7,000.
